David A. Wiseman, a Superior Court Associate Judge, has stated that the failure to roll out salary increase for employees working for the Tinian Casino Gaming Control Commission was a violation of the constitution.
It was alleged in the lawsuit that the mayor and the treasurer's refusal to pay the salary increase of Tinian Casino Gaming Control Commission's employees violated the constitutional rights of said employees. It was claimed that this was because there hadn't been a hearing, and due process hadn't been followed.
However, Judge Wiseman added that the right of the employees of the Tinian Casino Gaming Control Commission to receive the salary increase that was central to the lawsuit hadn't been clearly established in the complaint.
Judge Wiseman's decision said in part that, "the Casino Gaming Control Act provides that the commission may appoint its members and set its members' salaries." Furthermore, it was noted that the Commonwealth Civil Service System does not apply to the people that are covered by the Casino Gaming Control Act.
Judge Wiseman said that this lack of any clearly established rights for the Tinian Casino Gaming Control Commission's employees to receive a salary increase in the complaint meant that the mayor's office had met its burden to demonstrate that the qualified defense should not apply.
Robert O'Connor, who is on the legal committee for the Tinian Casino Gaming Control Commission, said on Thursday that the decision that Judge Wiseman had arrived at was "a clear victory for the commission."
